According to Diddy’s legal team, federal agents stormed his detention cell and took a slew of confidential information, including notes to his lawyers regarding his future trial… TMZ has learned.
According to fresh legal documents acquired by TMZ, Diddy’s lawyer Marc Agnifilo alleges they only learned Friday night that prosecutors have attorney-client protected data confiscated from Diddy’s detention cell at the Metropolitan Detention Center in Brooklyn.
Agnifilo argues that the privileged files include Diddy’s handwritten notes to his legal team about defense witnesses and defense strategies for his upcoming trial in May.
According to Diddy’s counsel, the feds have already admitted to owning notes found in Diddy’s cell, and the search and seizure violates Diddy’s Fourth, Fifth, and Sixth Amendment rights.
Furthermore, Diddy’s legal team claims the notes were stolen from his cell and handed over to the trial prosecutors in his case, who he suspects may have utilized the information in a legal file to keep Diddy in prison.
Diddy’s lawyer is requesting an immediate hearing to determine who authorized the search of Diddy’s cell, who determined what materials to take, who decided to give these materials to the U.S. Attorney’s Office, who decided to give the materials to the trial prosecutors, who decided not to inform Diddy about the seizure, and what exactly was taken.
In the documents, Diddy’s lawyer further criticizes the FBI, claiming that the search and seizure were “outrageous government conduct amounting to a substantive due process violation.”
We contacted the feds, but have yet to hear back.
