U.S. Immigration and Customs Enforcement (ICE) arrested a Haitian man who was in the U.S. illegally on charges of raping a pregnant woman at a migrant hotel in Massachusetts.
Marc Kervens Beauvais, 34, was caught on August 13 in the city of Peabody, which is north of Boston. This was almost two weeks after he was arrested on charges of aggravated rape, two counts of assault and battery with a dangerous weapon on a pregnant victim, and an attempt to commit a crime.
Several law enforcement officials say the rape took place in a hotel for migrants.
Police in Peabody arrested Beauvais on July 31 for the crimes. He was tried in Peabody District Court on August 1.
ERO Boston tried to get an immigration detainer against Beauvais while he was in jail.
A judge let Beauvais go free on his recognizance during a court meeting on Tuesday, but ICE officers in the room arrested him right away.
“Marc Kervens Beauvais is charged with horrible crimes against a pregnant woman in Massachusetts,” said Todd M. Lyons, director of the ERO Boston Field Office. “We can’t let anyone who is such a threat prey on the people who live in our communities,”
“ERO Boston will continue our mission of prioritizing public safety by aggressively apprehending and removing egregious noncitizen offenders from New England.”
Border Patrol caught Beauvais on June 26, 2021, near Del Rio, Texas, after he broke the law and came into the U.S. After that, he was let into the U.S. with a notice to appear for processing.
ICE found and nabbed another Haitian immigrant, 26-year-old Cory B. Alvarez, the same week. Alvarez had been free on $500 bond in June, even though he was charged with raping a child at a different Massachusetts migrant hotel in March.
Alvarez had an ICE detainer filed against him, but the local sheriff’s office didn’t care about it and let the 26-year-old go on low bail. A detainer is a request that tells ICE about a person that the government thinks should be deported so that ICE can take that person into federal custody and remove them.
It was said that Alvarez was caught in a “sanctuary city,” but the detainer was not followed.
Law enforcement sources told Fox News Digital that ICE agents found Alvarez in Brockton, Massachusetts, on Tuesday.
He got here in June 2023 through the CHNV release process for Cubans, Haitians, Nicaraguans, and Venezuelans. In October 2022, the policy was first made public for Venezuelans. It let a certain number of people fly straight into the U.S. as long as they weren’t here illegally, had a sponsor in the U.S. already, and passed certain checks.
In March, Alvarez was accused of raping a 15-year-old girl while living at a migrant hotel in Massachusetts. This is what he is being charged with. His lawyer says that he is not guilty of the charges.
