Proud Boys Members Face Federal Conspiracy Charges for Jan. 6 Riots Actions

Race Day Live (Washington DC) – Two Proud Boys members have been charged with federal conspiracy after throwing smoke grenades toward a line of cops guarding the United States Capitol during the Jan. 6 rioting.

A second superseding indictment was issued on Wednesday, charging Nicholas DeCarlo, also known as “Dick Lambaste,” and Nicholas Ochs, a founding member of the Proud Boys Hawaii chapter, with conspiracy. They were sentenced to four years in jail for their roles in the disturbances after pleading guilty to obstruction of an official process in September 2022.

They were among the Jan. 6 defendants who sought to have their obstruction charges dismissed before the Supreme Court limited the scope of the specific obstruction charge in such cases.

Court documents outline their cases and the statements they made with other members of the Proud Boys after the 2020 presidential election. In response to news that “Biden won” the election and that it could lead to “civil war,” Ochs replied, “The odds are with us because of the Supreme Court boys. I’m pro violence but don’t blow your load too soon.”

“Not to be an anti-murder buzzkill but I really think this ISN’T f—ed. Once it is, let’s go wild,” Ochs added, according to court documents.

Authorities said the two solicited funds online to go from their home states to Washington, D.C. DeCarlo launched a smoke grenade at the police line.

Ochs also tossed a smoke grenade into the police line. They allegedly walked into the Capitol building and photographed themselves smoking cigarettes in the Crypt.

They shared the moment on social media, captioned “Hello from the Capital lol.”

In the Rotunda, among other rioters, Ochs and DeCarlo exclaimed, “Nancy’s office!” and pointed to a doorway before exiting the building at 3 p.m.

Shortly later, DeCarlo scribbled “Murder the Media” in permanent marker on the Chestnut-Gibson Memorial Door, as Ochs captured the moment on his phone. The two allegedly posed for photos in front of it and shared them on social media.

The two allegedly rummaged through a US Capitol Police duffel bag near the Memorial Door, and DeCarlo stole a pair of plastic zip-tie shackles, according to authorities.

Walking away from the Capitol, with the building visible behind him, Ochs allegedly exclaimed, “Sorry we couldn’t go live when we stormed the f—-in’ U.S. Capitol and made Congress flee.”
