Woman Faces Possible Arrest After 1.2-Pound Fetus Discovered in Clogged Restaurant Toilet, Says NYPD

Lower Manhattan — A 20-year-old woman who may have miscarried in a Manhattan restaurant bathroom last week might face criminal charges after staff discovered the 1.2-pound fetus in a clogged toilet, police said Tuesday.

According to NYPD Chief of Detectives Joseph Kenny, the fetus, which is thought to be 22 or 23 weeks gestation, was discovered at Sophie’s Cuban Cuisine at 76 Fulton St. near Gold Street in the Financial District just before 10 a.m. on Sept. 30.

According to Kenny, the woman was a restaurant customer the day before cleaners discovered the baby in the backed-up toilet.

“She leaves the bathroom, and employees are alerted that the bathroom is dirty,” Kenny said during a news session. “The next day, they come in and find that it’s clogged.”

Kenny said the fetus weighed 543 grams or about 1.2 pounds, and the placenta and umbilical cord remained linked to the kid.

According to authorities, the medical examiner determined the infant may have breathed once or twice but would not have survived. The youngster exhibited no noticeable defects.

According to Kenny, investigators have identified the mother and are working with the Manhattan District Attorney’s Office to determine if she will face charges.

“Most likely it would lead to the arrest of concealment of a human corpse, which is a (class) E felony,” added the officer.
